Terms and Conditions

The pages of this website including any documents or statements appearing on this website are written to inform you of the terms and conditions (hereinafter referred to as “Terms and Conditions”) for using the Pbidding website. The website address is www.pbidding.com (hereinafter referred to as “Website”) Please read these “Terms and Conditions” carefully before making a decision to use the services. In case you use services with the Website, it shall be deemed you have accepted these Terms and Conditions and those shall constitute an agreement between you and Pbidding Co., Ltd. (“Company”). You have agreed that you are more than 20 years old pior using this website.

          1.     Conditions for participating in the auction

·      In the event that the auction price ends at the amount THB 0 - 100,000 the premium will be charged at the rate of 10 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 10%.

·      In the event that the auction price ends at the amount THB 100,001 – 250,000 the premium will be charged at the rate of 9 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 9 %.

·      In the event that the auction price ends at the amount THB 250,001 – 500,000 the premium will be charged at the rate of 8 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 8 %.

·      In the event that the auction price ends at the amount THB 500,001 – 1,000,000 the premium will be charged at the rate of 7 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 7 %.

·      In the event that the auction price ends at the amount THB 1,000,001 – 2,500,000 the premium will be charged at the rate of 6 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 6 %.

·      In the event that the auction price ends at the amount THB2,500,001 – 5,000,000 the premium will be charged at the rate of 5 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 5 %.

·      In the event that the auction price ends at the amount THB 5,000,001 – 10,000,000 the premium will be charged at the rate of 4 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 4 %.

·      In the event that the auction price ends at the amount THB 10,000,001 – 999,999,999 the premium will be charged at the rate of 3 % of the price at the end of the auction by collecting from both the auctioneer and the bidder equally at each 3 %.

      Charged premiums are exclusive of VAT, commission, shipment fee and credit card payment fees.

      4.     Registration to bid
The Company reserves the right to allow only those who have registered with the Website to be able to participate in the auction. You can register at www.pbidding.com, the bidders must apply for membership and verify his/her identity under the conditions determined by the Company.

Before bidding, you must agree to the Terms and Conditions determined by the Company. You will be able to bid once the auction has begun. Any expression of intention to bid in the auction is considered an irrevocable bidding. The Company reserves the right at its sole discretion to deny your right to bid whether before, after or at the end of the auction. The Company reserves the right to revoke the auction at any time.

      5.     Auction
The bidder who win the auction that has passed the Company's qualifications will be the winning bidder. The Company reserves the right at its sole discretion to determined the auction conditions including but not limited to the right to certify the winning bidder, the right to correct errors or problems during the bidding process. The Company and the seller reserve the right not to be held any liability for system malfunctions and/or errors during the bidding process. The Bidder agrees and accepts that bids in the auction are irrevocable bindings and binding to the bidder.

          5.1 Online Auctions : The 30 Minute Rule
            The auction will be held online via the Company's Website only. Bidding must be made prior to the closing time of each auction period. If you outbid, you    will be notified by
            your email and your name will appear on the list of bidders who bid higher than others.

   
            In the event that you are the only bidder in that auction, you will win the auction unless the price you bid is below the minimum price or below the price reserved by another
            bidder.

 
In the event that another bidder outbids before the auction closes, the auction period will be extended for another 30 minutes and will extend continually until the highest price bidder is reached. Those who will be able to bid during the extended period will be those who bid higher than the current bid price or those who bid the reserve price higher than the current bid price bid price.

          5.2 Maximum Bids in advance

     Bidders can place “Maximum” bid in the auction according to the Company's bidding conditions. The auction will start from the highest price each time. Each additional bid
           amount will be in accordance with the additional amount specified in the Company's Terms and Conditions according to the bid price range. However, the maximum bids in
           advance must be consistent with the bidding amount set in each price range.

            6.     Bidding Increments
     The minimum rate for the minimum amount will be established as defined for the auction as follows.

            Remark: The amount according to the above table can be adjusted as appropriate.

            7.     Auction Postponement; Withdrawal

     The Company reserves the right to postpone the auction and/or extend the auction period and/or withdraw the auction even though the auction has ended depending on
     the Company's decision and you agree not to bring any lawsuits as a result of the Company postpone and/or withdraw the auction.

            8.     Bidders

      The bidders hereby certifies that

       8.1 The bidders are aware of the potential to pay the bidding price and well acknowledge that in case of winning the auction but fails to pay such biddings, all money submitted for the auction will be seized as the auction fee and the Company will be entitled to claim for damages.

        8.2 The money placed by bidders for the auction including the payment for winning of auction is money legally obtained and the bidders have the right to use such money for payment.

        8.3 By participating in bidding process, you agree to verify your identity according to the conditions determined by the Company including agreeing to disclose the status of
      financial stability according to the conditions as determined by the Company.

        8.4 The bidders agree that before bidding the goods, the bidders are well informed the goods's specifications and/or its market price of the auctioned goods before making a bid

      decision.

        8.5 The auctioneers must have evidences proving the authenticity and credibility of the goods by showing evidences as specified by the Company.

        8.6 The Company can only certify the quality and/or origin of the goods according to the documents that the auctioneers provided to the Company.

        8.7 The bidders agree and well acknowledge that the goods being auctioned on the Website are not owned by the Company and in the event of disputes due to the authenticity of
      goods, the bidders agree not to bring any lawsuit against the Company but will make a claim directly to the auctioneers.

  8.8 The bidders well acknowledged that the goods being auctioned will be sold as is (As if). In case of any doubts and/or queries, the bidders will contact the auctioneers directly to obtain fully information before bidding decision.

            9.  Records of  sale of auctioned goods

      Records of the sale of auctioned goods are final and cannot be disputed. In the event of a discrepancy between any online records on Website or messages provided to you,
      the online records on Website will govern.

10. Goods Viewing
The Company reserves the right to arrange for viewing of the auctioned goods at the locations specified by the Company. The auctioneers can be contacted at admin@pbidding.co.th

             11. Bidder’s Obligations
             At the end of the auction, the winning bidder will automatically be deemed to have entered into an agreement for the sale and purchase of the goods. The Company will send
             the invoice to the winning bidder via email. The right of winning the auction shall not be transferred to a third party unless obtaining a consent of the Company.

                 ·  Payment

             unless otherwise agreed, the winning bidder must pay for the goods (including premiums, various taxes by laws) to the Company within 7 days from the date of the end of theauction. The Company will invoice to the bidder's email within 1 day after the end of the auction.

                ·  Ownership of the auctioned property

             The ownership of auctioned property shall not be vested in the winning bidder until the Company has received full payment of the invoice including delivery costs.

                ·  Shipping and receiving

       ·      The goods will not be delivered to the Buyer until the Company has received full payment of the invoice;

       ·      The winning bidders agree to pay for delivery costs as charged by the Company;

       ·      When the goods is delivered to the winning bidders, video records must be taken as evidence.

            12. The Company’s Obligations
            The Company is responsible for providing channels for bidding and acting as a middleman in co-ordination between the auctioneers and bidders only. The Company  shall not
             be under any circumstance of principal or representatives of both auctioneers and bidders.

                ·  Personal Data Protection

            The Company will keep, collect and process on personal data, and may send personal data of service users to third parties according to the personal data protection policy
            that appears on the Website at www.pbidding.com/privacy

            In the event that the service users wish to delete personal data, can contact us at admin@pbidding.co.th. However, the Company may deny the service users's right if it is
            necessary to collect the service users's information in accordance with the Personal Data Protection Act.

            13.  The Company’s Rights
             The Company reserves the right to deny to receive payment if it considers that money pays for the goods is suspected to be illegally obtained or such money does not belong
             to the service users.

              Failure to make payment according to the conditions

             If the winning bidder does not make payment according to the invoice within 7 days after the end of the auction. The winning bidder agrees and consents to the Company to
             take the following actions as appropriate:

       ·      Deduct from credit cards that you have registered to pay the full amount;

       ·      Cancel the sale of winning bid and deduct the deposit to pay for damages;

       ·      Charges an interest at the rate of 5% per year on the default money and/or damages;

       ·      Sell winning bid goods to others, whether the sale is made via Website auction or resell to others privately;

       ·      Take legal actions to claim for goods and/or damages, including all charges by applicable laws;

       ·      Deduct the price of goods (in case the winning bidder has other items auctioned with the Company) that the winning bidder is entitled to receive. The amount deducted by
      the Company includes various damages;

       ·      Disclose the information of the winning bidder to the auctioneer for legal action proceedings.

              14.   Severability

      Any provision that is void shall be deemed void only in part and without affecting the validity of any other remaining part of this agreement.

            15.   Account suspension

      The Company reserves the right to suspend the accounts as follows:

·      In the event that the winning bidder fails to pay the invoice or pays lately;

·      In the event that the service users are found to have a suspicious fraudulent manner, whether such manner is illegal or not, or acts that affect to the bid price;

·      In the event that a service user has applied for more than 2 accounts, the Company reserves the right to suspend all service user accounts.

            16.   Limitation of Liability

      The Company shall not liable for any system errors occurring during auction, or any errors occurred from software, system, Website, server, force majeure, or others occurred
      during the auction including to reserves the right to withdraw and/or re-arrange a new auction in case such events occur in which the service users agree not to make any
      claims from the Company.
